The Court of Appeal affirmed defendant's conviction for first degree murder, first degree burglary, and conspiracy to commit murder. In the published portion of the opinion, the court held that Proposition 57 does not apply retroactively to defendant's case, and thus rejected defendant's claim that retroactivity to juvenile offenders with life without the possibility of parole sentences was required under Montgomery v.
