An agreement to arbitrate a Labor Code Private Attorneys General Act of 2004 (PAGA) claim, entered into before an employee is statutorily authorized to bring such a claim on behalf of the state, is an unenforceable predispute waiver. The Court of Appeal held that the trial court properly denied a petition to compel arbitration of respondents' claim under PAGA.
