People v. Almanza

Following rehearing, the Court of Appeal remanded this case to the trial court so that it may exercise it's independent discretion on whether to strike or dismiss a firearm enhancement. In this case, defendant was convicted of first degree murder and assault with a firearm. Defendant's case was remanded for consideration of Senate Bill No. 620, which gives the trial court discretion to impose a lower sentence and applied retroactively.
