People v. Jones

The Court of Appeal reversed defendant's conviction for second degree murder and child abuse, holding that her waiver of her right to a jury trial was not knowing, intelligent, and voluntary. The court held that the trial court's two-question inquiry to defendant did not show that she understood the nature of the right to a jury trial she was relinquishing. Furthermore, the record did not show that defendant understood that a jury was comprised of individuals from the community instead of, for example, a collection of judges. The court also held that there was sufficient corroboration of her boyfriend's accomplice testimony and that substantial evidence supported the convictions. View "People v. Jones" on Justia Law
