This appeal centered whether Section 6 of the California Constitution required the state to reimburse the defendant local governments (collectively permittees or copermittees) for costs they incurred to satisfy conditions which the state imposed on their stormwater discharge permit. Defendant-respondent Commission on State Mandates (the Commission) determined that six of the eight permit conditions challenged in this action were reimbursable state mandates. They required permittees to provide a new program. Permittees also did not have sufficient legal authority to levy a fee for those conditions because doing so required preapproval by the voters. The Commission also determined that the other two conditions requiring the development and implementation of environmental mitigation plans for certain new development were not reimbursable state mandates. Permittees had authority to levy a fee for those conditions. On petitions for writ of administrative mandate, the trial court upheld the Commission’s decision in its entirety and denied the petitions. Plaintiffs, cross-defendants and appellants State Department of Finance, the State Water Resources Board, and the Regional Water Quality Board, San Diego Region (collectively the State) appealed, contending the six permit conditions found to be reimbursable state mandates were not mandates because the permit did not require permittees to provide a new program and permittees had authority to levy fees for those conditions without obtaining voter approval. Except to hold that the street sweeping condition was not a reimburseable mandate, the Court of Appeal affirmed the trial court's judgment. View "Dept. of Finance v. A qui tam plaintiff alleged that two banks violated the California False Claims Act (CFCA) by failing to report and deliver millions of dollars owing on unclaimed cashier’s checks to the State of California as escheated property. The trial court denied the banks’ motions to dismiss. The banks sought writ relief.The court of appeal denied relief, upholding the denial of the motions to dismiss. The court rejected the banks’ argument that a qui tam plaintiff may not pursue a CFCA action predicated on a failure to report and deliver escheated property unless the California State Controller first provides appropriate notice to the banks under Code of Civil Procedure section 1576. For pleading purposes, the complaints adequately allege the existence of an obligation as required under the CFCA: the plaintiff adequately alleged that the banks were obligated to report and deliver to California the money owed on unredeemed cashier’s checks, Allowing this action to proceed does not violate the banks’ due process rights. Appellants Bull Field, LLC, Barley, LLC and Colburn Hills Ranch, LLC (Appellants) appeal from a judgment denying their petition for a writ of mandate (Petition). Appellants sought an order compelling respondent Merced Irrigation District (District) to sell them surplus surface water for the 2019 water year. Appellants’ farmland is outside the District, but within the same groundwater basin as the District’s service area. The District authorized the sale of surplus water to out-of-district users for 2019 but denied Appellants’ application to purchase such water. The District claimed, and the trial court found, that the District’s general manager denied Appellants’ applications to purchase surplus surface water because the District had a history of difficult dealings with Appellants’ manager. Substantial evidence supports that finding.   The Second Appellate District affirmed, finding that District acted within its discretion in making its decision on this ground. The court explained that the court may not interfere with the District’s discretionary decision that denying Appellants’ applications to purchase surplus water was in its best interest. The court may not substitute its judgment for the District about how its interests would best be served. This appeal concerned a particular rate known as a “base rate,” which State Compensation Insurance Fund (State Fund) used to calculate premiums for its insureds. California Insurance Code section 11664(e)(6)(A) stated: “[i]f the premium rate in the governing classification for the insured is to be increased 25 percent or greater and the insurer intends to renew the policy, the insurer shall provide a written notice of a renewal offer not less than 30 days prior to the policy renewal date.” In a matter of first impression, the Court of Appeal found State Fund was not obligated to provide notice to cross-complainant Cover Right Roofing (Cover Right) under this statute. The increase at issue was not due to any change in the premium rate of Cover Right’s governing classification. Rather, a third party changed the applicable governing classification criteria, which caused Cover Right to be assigned a new governing classification with a higher premium rate. The statute did not require notice in such circumstances. Thus, the Court found the trial court correctly granted State Fund’s motion for summary judgment and affirm the judgment. In this case's previous trip to the Court of Appeal, the Court reversed the trial court’s judgment overturning a cleanup order issued by the California Regional Water Quality Control Board, Central Valley Region (Regional Board). The cleanup order directed Atlantic Richfield Company (ARCO) to remediate hazardous waste associated with an abandoned mine in Plumas County. The mine was owned by the Walker Mining Company, a subsidiary of ARCO’s predecessors in interest, International Smelting and Refining Company and Anaconda Copper Mining Company (International/Anaconda). The Court of Appeal held the trial court improperly applied the test articulated in United States v. Bestfoods, 524 U.S. 51 (1998) for determining whether a parent company is directly liable for pollution as an operator of a polluting facility owned by a subsidiary. On remand, the trial court entered judgment in favor of the Regional Board, concluding “[t]he record supported a determination of eccentric control of mining ‘operations specifically related to pollution, that is, operations having to do with the leakage or disposal of hazardous waste.’ ” ARCO appealed, contending: (1) the trial court improperly applied Bestfoods to the facts of this case, resulting in a finding of liability that was unsupported by substantial evidence; (2) the Regional Board abused its discretion by failing to exclude certain expert testimony as speculative; (3) the Regional Board’s actual financial bias in this matter required invalidation of the cleanup order for violation of due process; and (4) the cleanup order erroneously imposed joint and several liability on ARCO. Condominium owners alleged that a sewer service charge collected by Napa Sanitation District consists of a “capacity fee” and a “use fee” and that the latter was an unlawful tax. A challenge to the capacity fee was barred by a 120-day limitations period, Government Code 66022 Although the complaint expressly did not attack the capacity fee, the District argued that the ordinances authorizing the sewer service charge are inseverable, so the court would have to invalidate the entire charge if the plaintiffs prevailed. The trial court dismissed the suit.The court of appeal reversed. It was premature for the trial court to decide the issue of severability. The severability doctrine is intended to determine the scope of the remedy after a legal infirmity in the ordinance has been established; a finding of in-severability would not alter the nature of the claim or the underlying rights. Even if severability principles would require the invalidation of the entire sewer service charge, the District, rather than the plaintiffs, would bear the consequence of its decision to draft the ordinances that way. Severability is a shield by which a legislative body can preserve parts of its law that are not implicated by a valid legal claim, not a sword to preclude that claim, View "Raja Development Co., Inc. v. Plaintiff and appellant Dedication and Everlasting Love to Animals, Inc. (DELTA) owns a vacant lot in the City of El Monte (City or El Monte). After receiving several citations for violating the municipal code, DELTA sought administrative review. The citations were upheld, and DELTA appealed to the superior court, which affirmed the administrative opinion. DELTA then attempted to appeal to the appellate division of the superior court, but when its filing was rejected, it appealed to the Second Appellate District court instead.The Second Appellate District determined that it lacked jurisdiction over this "limited civil matter." From August 2018 through January 2019, plaintiffs were six-year-old first grade students who attended Maple Elementary School (Maple) within the Hesperia Unified School District (the District). Pedro Martinez worked at Maple as a janitor. Martinez’s position as a janitor did not require him to have any one-on-one contact with the students. Martinez engaged in a variety of activities with the students that plaintiffs characterized as “‘grooming’ activities” that were “designed to lure minor students, including [p]laintiffs, into a false sense of security around him.” Plaintiffs alleged that numerous District employees who were mandated reporters under the Child Abuse and Neglect Reporting Act (CANRA), witnessed Martinez’s behavior and did not report it to school officials or to law enforcement, in violation of the District’s policies. In January 2019, the State charged Martinez with numerous felonies involving his alleged sexual abuse of minors. In February 2019, plaintiffs filed a lawsuit against the District and Martinez, alleging numerous claims arising from Martinez’s alleged sexual abuse of plaintiffs. The trial court was persuaded by the District's argument, concluding that plaintiffs did not adequately plead a negligence cause of action against the District, because they failed to state any facts “establishing that [the] District knew of any prior acts of sexual abuse by Martinez and/or that the District had actual or constructive knowledge that Martinez was abusing [p]laintiffs so as to impose liability upon [the] District.” One month after plaintiffs sought reconsideration, the trial court entered judgment against plaintiffs. Plaintiffs argued on appeal that they were not required to plead facts demonstrating that the District had actual knowledge of past sexual abuse by Martinez, and that they otherwise pled sufficient facts to state negligence causes of action against the District. The Court of Appeal agreed with plaintiffs on all of those points. The Court disagreed with plaintiffs' contention that the trial court erred by dismissing their sex discrimination claims under Title IX and California Education Code section 220: plaintiffs’ allegations are insufficient to constitute actual notice of a violation of Title IX or Education Code section 220. The judgment of dismissal was reversed, the order sustaining the demurrer to the third amended complaint was vacated, and the trial court was directed to enter a new order sustaining the demurrer without leave to amend as to the causes of action under Title IX, Education Code section 220, and the Unruh Civil Rights Act but otherwise overruling the demurrer. Petitioner Andrew Shouse was terminated from his employment as a captain of the Riverside County Sheriff’s Office (RCSO, the Department, or respondent), following an administrative hearing. Findings on the record reflected petitioner engaged in improper sexual relationships with subordinates under his command, misappropriated county equipment and electronic mail for his personal use, was insubordinate in violating a direct order prohibiting him from contacting any person with whom he had had a personal relationship during the pendency of the investigation, and unbecoming conduct discrediting the Sheriff’s Department. Following an administrative appeal, the findings were sustained. Petitioner petitioned for writ of mandate seeking review of his dismissal, and, upon denial of that petition, he appealed. The sole legal issue presented was whether petitioner’s rights pursuant to the Public Safety Officer’s Bill of Rights (POBRA) were violated where the investigation into his alleged improper conduct was not completed within one year of discovery. Amiodarone was developed in the 1960s for the treatment of angina and was released in other countries. Amiodarone is associated with side effects, including pulmonary fibrosis, blindness, thyroid cancer, and death. In the 1970s, U.S. physicians began obtaining amiodarone from other countries for use in patients with life-threatening ventricular fibrillation or ventricular tachycardia who did not respond to other drugs. In 1985, the FDA approved Wyeth’s formulation of amiodarone, Cordarone, as a drug of last resort for patients suffering from recurring life-threatening ventricular fibrillation and ventricular tachycardia. The FDA’s “special needs” approval issued without randomized clinical trials. In 1989, the FDA described Wyeth’s promotional activities as promoting an unapproved use of the drug. In 1992, the FDA objected to promotional labeling pieces for Cordarone. Other manufacturers developed generic amiodarone, which has been available since 1998.Consolidated lawsuits alleged that plaintiffs suffered unnecessary, serious side effects when they took amiodarone, as prescribed by their doctors, for off-label use to treat atrial fibrillation, a more common, less serious, condition than ventricular fibrillation. The FDA never approved amiodarone for the treatment of atrial fibrillation, even on a special-needs basis. The court of appeal affirmed the dismissal of the lawsuits. The claims are preempted as attempts to privately enforce the Federal Food, Drug, and Cosmetic Act, 21 U.S.C. 301, regulations governing medication guides and labeling and have no independent basis in state law. The court also rejected fraud claims under California’s unfair competition law and Consumers Legal Remedy Act. View "Amiodarone Cases" on Justia Law
