In this case, plaintiffs Brandi Stiles and Abel Gorgita purchased a 2011 Kia Optima in April 2013. The car, manufactured and distributed by Kia Motors America, Inc., was sold with express warranties still in effect from the original sale. However, the car had serious defects, including issues with the transmission, electrical system, brakes, engine, suspension, and steering. Despite multiple attempts, Kia was unable to repair these defects. The plaintiffs argued that Kia failed to replace the car or make restitution as required under the Song-Beverly Consumer Warranty Act.The trial court sustained Kia's demurrer, arguing that the remedies sought by the plaintiffs under the Song-Beverly Act only apply to new motor vehicles. The court relied on a previous case, Rodriguez v. FCA US, LLC, which held that a used motor vehicle with an unexpired warranty is not a "new motor vehicle" under the Song-Beverly Act. The court rejected another case, Jensen v. BMW of North America, Inc., which held that a previously owned motor vehicle with an unexpired warranty qualifies as a "new motor vehicle" under the Song-Beverly Act.The Court of Appeal of the State of California Second Appellate District Division Six reversed the trial court's decision. The court held that a previously owned motor vehicle purchased with the manufacturer’s new car warranty still in effect is a “new motor vehicle” as defined by section 1793.22, subdivision (e)(2) of the Song-Beverly Act. Thus, the replace or refund remedy of section 1793.2, subdivision (d)(2) applies. The court rejected Kia's arguments and affirmed the interpretation of the Song-Beverly Act in Jensen v. The plaintiff, Donald Ververka, was an administrator for a veterans home operated by the California Department of Veterans Affairs (CalVet). He was removed from his position after reporting safety and health issues at the home and potential violations of federal law to his superiors and an independent state agency. Ververka sued CalVet, alleging that his termination was in retaliation for his whistleblowing activities, in violation of Labor Code section 1102.5.The case went to trial, and the jury found that Ververka's protected disclosures were contributing factors in CalVet's decision to remove him. However, the jury also found that CalVet was not liable because it proved it would have made the same decision for non-retaliatory reasons. After the trial court entered judgment for CalVet, Ververka moved to vacate the judgment, arguing that he was entitled to declaratory relief and reasonable attorney’s fees and costs. The trial court denied the motion.On appeal, Ververka argued that the trial court erred in denying his motion to vacate the judgment. He contended that an employer’s “same decision” showing under section 1102.6 precludes only an award of damages and backpay and an order of reinstatement, and as a result, he was entitled to declaratory relief and reasonable attorney’s fees and costs. The Court of Appeal disagreed, concluding that the whistleblower statutes are not reasonably susceptible to Ververka’s interpretation. John Sandy Campbell, a Resource Specialist Teacher at Chavez Social Justice Humanitas Academy from 2015 to 2017, was dismissed from her employment with the Los Angeles Unified School District due to excessive absences and other issues. The Commission on Professional Competence upheld her dismissal, and Campbell challenged this decision by filing a petition for writ of mandate in the superior court. The superior court, exercising its independent judgment, denied Campbell’s petition and upheld her dismissal.The proceedings to adjudicate Campbell’s dismissal were extensive, with the administrative hearing spanning 11 days. Campbell contended that the superior court erred in affirming her dismissal because the Commission miscited and applied the wrong statutory subdivisions at her dismissal hearing, and the court failed to apply “new” precedent when determining Campbell’s fitness to teach. The superior court recognized that the Commission cited incorrect subdivisions of section 44932 in its legal conclusions but noted that the Commission accurately listed, by name, the correct section 44932 causes for Campbell’s dismissal in these legal conclusions.The Court of Appeal of the State of California Second Appellate District Division Eight affirmed the superior court's decision. The appellate court found that Campbell had not demonstrated error in the lower court's decision. The court also rejected Campbell's insufficiency challenge due to her failure to present all the relevant evidence. Furthermore, the court found Campbell's argument that the superior court erred by not applying a more recent case law unconvincing. This case involves a lawsuit filed by Cornelius Williams against J-M Manufacturing Company, Inc. (JMM), a supplier of asbestos-cement pipe. Williams alleged that he developed mesothelioma due to secondary exposure to asbestos from his brother Nathan's work with asbestos-cement pipe over a period of more than 20 years. Williams and Nathan did not live together, but had regular close contact during Nathan's employment. The jury found JMM liable under theories of design defect and failure to warn, concluding that the pipe sold by JMM was a substantial factor in increasing Williams' risk of developing cancer. JMM appealed the decision.The trial court dismissed Williams' negligence claim, but not the strict liability claim. The jury found in favor of Williams on his remaining strict liability claim, awarding him significant damages. JMM moved for judgment notwithstanding the verdict (JNOV) and, in the alternative, for a new trial, arguing that the trial court erred in its interpretation and application of a previous case, Kesner v. Superior Court, to preclude only the negligence cause of action. The motion was denied. JMM also appealed from the judgment and order denying its motion for JNOV.The Court of Appeal of the State of California First Appellate District Division Two affirmed the lower court's decision. Hernandez signed an arbitration agreement with Sohnen, which stated that any disputes would be governed by the Federal Arbitration Act (FAA). When Hernandez filed a complaint against Sohnen for disability discrimination and Labor Code violations, the parties agreed to arbitrate. However, Sohnen failed to pay the arbitration fees within 30 days of the due date. Hernandez then filed a motion to withdraw from arbitration and litigate in state court, as permitted under California Code of Civil Procedure section 1281.97. The trial court granted the motion, finding that Sohnen had breached the arbitration agreement.Sohnen appealed, arguing that the FAA, not California law, governed the arbitration agreement and preempted section 1281.97. The Court of Appeal of the State of California, Second Appellate District, Division Five, agreed with Sohnen. The court found that the arbitration agreement was governed by the FAA, including both its substantive and procedural provisions. As a result, the procedures of section 1281.97 did not apply, and the trial court's order was reversed. The court also held that even if section 1281.97 did apply, it would still reverse the order because the FAA preempts the provisions of section 1281.97 that mandate findings of breach and waiver when an agreement falls within the scope of the FAA and does not expressly adopt California arbitration laws. Mar, who was a partner in Sierra, sought a buyout of his partnership interest. Sierra defendants moved to compel arbitration of Mar's action, based on an arbitration agreement included in Sierra's employee handbook. Mar had refused to sign the arbitration agreement, stating that he would not be bound by it and that Sierra could terminate his employment if it objected. Sierra argued that Mar's continued employment for 19 months after the introduction of the arbitration agreement constituted assent to the agreement.The Superior Court of Los Angeles County denied Sierra defendants' motion to compel arbitration. The court found that Sierra defendants failed to meet their burden to establish the existence of an arbitration agreement because Mar clearly stated that he refused to sign the arbitration agreement and Sierra could terminate his employment if it objected.On appeal, the Court of Appeal of the State of California, Second Appellate District, Division Seven, affirmed the lower court's decision. The appellate court held that while an employee's continued employment can generally be taken as assent to an arbitration agreement, this is not the case when the employee promptly rejects the arbitration agreement and makes clear he or she refuses to be bound by the agreement. This case involves a marital dissolution proceeding between Monique Covington Moore and Charles Moore. During the discovery process, Covington served deposition subpoenas for the production of business records on nonparties Rocket Lawyer, Inc. and Acendi Interactive Company, LLC. Both companies objected and refused to comply with most of the subpoenas’ demands. Covington then filed a motion to compel their compliance. The trial court granted the motion in substantial part and ordered each company to pay Covington $25,000 in monetary sanctions. The companies appealed, raising several claims of error regarding the trial court’s rulings.The trial court had found that Rocket Lawyer and Acendi did not act with the requisite substantial justification in resisting the subpoenas. The court ordered them to comply with most of the document demands, subject to a protective order, and imposed monetary sanctions. The companies appealed, arguing that Covington’s motion was untimely, that her attempts to meet and confer were insufficient, and that the monetary sanctions were unreasonable, among other issues.The Court of Appeal of the State of California First Appellate District Division Three affirmed the trial court’s rulings in most respects. However, it agreed with the companies that the fees and costs Covington incurred in mediation as meet and confer attempts after her discovery motions were already filed were not compensable as discovery sanctions. In September 2021, John Sandy Campbell filed a lawsuit against her former employer, the Los Angeles Unified School District, alleging racial discrimination and retaliation for whistleblowing. These allegations were in violation of Labor Code sections 1102.5 and 1106 and Government Code section 12940 (the Fair Employment and Housing Act). The District demurred, arguing that Campbell had not complied with the Government Code’s claim presentation requirement and that the statute of limitations barred her cause of action under the Act. The trial court sustained the District's demurrer without leave to amend, citing Le Mere v. Los Angeles Unified School District and Government Code section 12965, subdivision (c)(1)(C).The Court of Appeal of the State of California Second Appellate District Division Eight reviewed the trial court's ruling independently and applied the standard for demurrers. The court agreed with the trial court, stating that a plaintiff suing a public entity for damages must timely present a written claim to the entity before filing suit. Campbell had not demonstrated that she substantially complied with the claim presentation requirement. Furthermore, Campbell's amended complaint did not plead compliance with the claim presentation requirement.Additionally, Campbell's claim for violation of the Act was time-barred. The Department of Fair Employment and Housing had provided Campbell a Right to Sue notice dated October 9, 2018, giving her one year to file a civil action. Campbell did not sue until September 2021, making her suit untimely. The court also rejected Campbell's argument that the discovery rule saved her lawsuit. In August 2020, Governor Gavin Newsom and the California Department of Public Health (CDPH) introduced the Blueprint for a Safer Economy, a color-coded, risk-based framework for managing restrictions during the COVID-19 pandemic. The Blueprint included restrictions on business activities, including customer capacity limitations. Plaintiffs, Central California businesses and their owners, filed suit against the Governor and others responsible for creating and enforcing the Blueprint, alleging that its creation and enforcement were unlawful. They claimed that the Governor and CDPH lacked statutory authority to implement the Blueprint, and that broadly interpreting the Emergency Services Act (ESA) and Health and Safety Code section 120140 conferred unfettered discretion on defendants to impose restrictions on businesses, violating the California Constitution’s non-delegation doctrine.The trial court denied plaintiffs' motion for a preliminary injunction seeking to enjoin the enforcement of the Blueprint. On appeal, the court dismissed the appeal as moot because the Governor had rescinded the Blueprint. After this, the parties cross-moved for summary judgment. The trial court granted defendants’ motion and denied plaintiffs’ motion, holding that the Third District Court of Appeal’s decision in Newsom v. Superior Court (Gallagher) had rejected the same challenges to the Governor’s emergency powers that plaintiffs assert. The court entered judgment in defendants’ favor.The Court of Appeal of the State of California Fifth Appellate District affirmed the judgment. The court followed Gallagher and concluded it governs the outcome of this appeal. The court held that the ESA permitted the Governor to amend or make new laws and did not violate the constitutional separation of powers by delegating quasi-legislative power to the Governor in an emergency. The court also found that the ESA contained several safeguards on the exercise of the power, including that the Governor must terminate the state of emergency as soon as possible and that the Legislature may terminate the emergency by passing a concurrent resolution.
