Downey v. City of Riverside
Plaintiff-appellant Jayde Downey appealed the dismissal of her case after a trial court sustained without leave to amend the demurrers of defendants-respondents Ara and Vahram Sevacherian (collectively, Sevacherian) and the City of Riverside (City) to Downey’s operative complaint. Downey alleged causes of action for dangerous condition of property and negligence arising out of an automobile collision involving Downey’s daughter, Vance. In that pleading, Downey alleged the collision occurred “because [City] created or permitted to exist, a dangerous condition of public property” and because Sevacherian maintained vegetation and trees on their property so as to cause an unsafe obstruction to the view of vehicular traffic. She alleged that because she was on the phone with Vance and heard the sounds of the crash and its aftermath, she was “present, or virtually present” at the scene when the collision happened, thereby causing Downey "serious emotional injuries and damages." The trial court ruled Downey’s allegations were “insufficient to show that Downey had a contemporaneous awareness of the injury-producing event—not just the harm Vance suffered, but also the causal connection between defendants’ tortious conduct and the injuries Vance suffered.” Downey contended the court erred; that because she contemporaneously perceived the event causing injury to Vance, she adequately alleged a claim for negligent infliction of emotional distress as a bystander. The Court of Appeal reversed the trial court, finding that under the circumstances, Downey should be given an opportunity to allege facts establishing she had the requisite “‘contemporaneous sensory awareness of the causal connection between the negligent conduct and the resulting injury.’” View "Downey v. Pool-O’Connor v. Guadarrama
This case involves disputes over the disposition of assets. The assets at issue include monies and real and personal property assets held in trust pursuant to the Albert R. Pool Family Revocable Trust (“Original Trust Instrument”) as amended and restated in the 2013 Amendment and Restatement of the Albert R. Pool Family Revocable Trust (unnecessary capitalization omitted) (“Amended/Restated Trust” or “Trust”). Appellant was the deceased’s nephew, as well as his attorney-in-fact under a durable power of attorney (POA), executor under a pour-over, will, and successor Trustee under the Amended/Restated Trust. Appellant appealed from an order (the “subject order”) of the superior court sitting in probate (the “probate court”), in connection with an Amended Petition to Surcharge Trustee for Breach of Trust; Petition to Determine Trust Ownership of Assets and for Damages Pursuant to Probate Code Section 859 brought by Respondents each of whom were beneficiaries under the Amended/Restated Trust.
The Fifth Appellate District affirmed the probate court’s disposition of the Subject Property in the subject order. The court explained that even had evidence existed to demonstrate that the deceased wanted Appellant to have the subject funds, the lack of any written document authorizing Appellant to deposit the monies into the joint account would be fatal to Appellant’s appeal concerning the subject funds. The court concluded Appellant’s deposit of the subject funds violated section 4264, subdivision (f) by effectuating a change in the designation of beneficiaries who would have otherwise shared in the entitlement to the subject funds. McCormick v. California Public Employees’ Retirement System
McCormick sought disability retirement based on symptoms caused by her office environment. The California Public Employees’ Retirement System (CalPERS) denied her application. The court of appeal held that CalPERS members are eligible for disability retirement under the Public Employees’ Retirement Law (Gov. Code 20000) when they can no longer perform their usual duties at the location where they are required to work. A CalPERS member need not request an accommodation to become eligible for disability retirement. On remand, McCormick sought "prevailing party" attorneys' fees under Code of Civil Procedure section 1021.5, which applies when the action has conferred a significant benefit "on the general public or a large class of persons.”The court of appeal reversed the denial of that motion, finding that its prior opinion conferred a significant benefit on the public and that McCormick is otherwise entitled to attorney fees under section 1021.5. The conclusions reached in the earlier decision confer a benefit on a group larger than those CalPERS members who might seek disability retirement in factual circumstances similar to McCormick’s. The opinion emphasized that disability must be judged in light of a member’s actual job location and duties and that members need not seek an accommodation to become eligible. View "McCormick v. Westmoreland v. Kindercare Education LLC
When she was hired by Kindercare, Westmoreland signed a “Mutual Arbitration Agreement Regarding Wages and Hours,” including a “Waiver of Class and Collective Claims” and a “Savings Clause & Conformity Clause,” stating that if the Waiver of Class and Collective Claims is found to be unenforceable, the agreement is invalid and any claim brought on a class, collective, or representative action basis must be filed in court. Kindercare terminated Westmoreland. She filed suit asserting violations of the Labor Code, on an individual and class action basis. Kindercare successfully moved to compel arbitration of Westmoreland’s individual non-PAGA (Private Attorneys General Act) claims, and to stay her PAGA claim. The court of appeal concluded that the unenforceable PAGA waiver was not severable and rendered the entire agreement unenforceable. The California Supreme Court and the U.S. Supreme Court rejected Kindercare’s petitions for review. Kindercare filed a “Renewed Motion to Compel Arbitration of Non-PAGA Claims and Stay PAGA Claims Based on New Law” citing a July 2021 California decision, “Western Bagel.”The court of appeal affirmed, noting that an order denying a renewed motion is not appealable but exercising its discretion to hear the matter as a petition for writ of mandate. Western Bagel is not “new law” that justifies a different decision. As a consequence of Kindercare’s drafting decisions, the agreement is invalid by operation of the unambiguous “Savings Clause and Conformity Clause.” Kindercare must litigate all of Westmoreland’s claims in court. People v. Fredrickson
In 2016, Fredrickson (age 23) was charged, based on the discovery of honey oil (concentrated cannabis), marijuana, and equipment for honey oil production at her house. In 2019, Fredrickson pleaded no contest to manufacturing a controlled substance. The trial court suspended the imposition of sentence and placed Fredrickson on formal probation for three years with conditions, including that she serve 185 days in county jail. In February 2022, Fredrickson admitted probation violations, including failure to surrender for time in custody. The trial court revoked probation and sentenced Fredrickson to a five-year middle-term split sentence--two years in custody and three years of mandatory supervision.Penal Code 1170(b)(6)(B), effective January 1, 2022, establishes a presumption that the court should impose the lower term if the defendant’s youth was a contributing factor in her commission of a crime unless the court finds that the aggravating circumstances outweigh the mitigating circumstances such that imposition of the lower term would be contrary to the interests of justice. A “youth” is defined as any person under 26 years of age on the date of the crime.The court of appeal rejected Fredrickson’s argument that the court abused its discretion in failing to treat the lower term as the presumptive sentence. The court was not required to make an express finding regarding the presumption because nothing in the record shows Fredrickson’s youth was a “contributing factor.” The court also rejected Fredrickson’s ineffective assistance of counsel claim. Suffolk Construction Co. v. Los Angeles Unified School Dist.
This appeal arises from litigation involving a public construction project to build the Central Region 9th Street Span K-8 school in downtown Los Angeles. The Los Angeles Unified School District (LAUSD or District) and Suffolk Construction Company, Inc. (Suffolk), entered into a development and construction agreement (contract), for the development and building of the school. Suffolk later entered into subcontracts with various subcontractors, including R.J. Daum Construction Company (Daum) and Fisk Electric Company (Fisk). Throughout the project, various problems arose, which caused delay and disruption and resulted in increased costs to Suffolk, Daum and Fisk. Suffolk sued LAUSD, alleging breach of the contract, implied contractual indemnity, and seeking declaratory relief. The jury found that Suffolk substantially performed its contract and that LAUSD breached the implied warranty of correctness by providing plans and/or specifications for the concrete footing design that was not correct. Further, the jury determined Suffolk’s damages for the concrete issue decided in phase 1 (TIA 5).
The Second Appellate District found that the phase 1 verdict must be reversed and remanded for retrial on the ground that the special jury instruction based on Public Contract Code section 1104 was improper. The reversal of the phase 1 liability verdict requires that the phase 2 trial of damages for TIA 5 (related to the concrete cracking issue) must also be reversed and remanded for retrial. Finally, the court held that the trial court erred in granting JNOV on the phase 2 jury verdict. People v. Wilson
In 2004, Wilson was charged with shooting three people, killing two. Wilson argued that a deceased third party was the actual perpetrator. A jury found Wilson guilty of two counts of first-degree murder and one count of willful, deliberate, and premeditated attempted murder but was unable to reach a verdict on allegations that he personally used and intentionally discharged a firearm in the commission of the offense, causing great bodily injury and death. The court of appeal affirmed, stating there was sufficient evidence to support the convictions on a theory of accomplice liability and even “sufficient evidence to support a conviction on the direct perpetrator theory.”In 2018, Senate Bill 1437 amended the felony murder rule and the natural and probable consequences doctrine, to ensure that murder liability is not imposed on a person who is not the actual killer, did not act with the intent to kill, or was not a major participant in the underlying felony who acted with reckless indifference to human life.The court of appeal affirmed the denial of Wilson’s petition for resentencing. A jury’s inability to reach a verdict on the sentencing enhancement allegations for personally using and discharging a firearm does not preclude the court, in a subsequent Penal Code section 1170.95 hearing, from finding beyond a reasonable doubt that the defendant was the actual shooter. The evidence was sufficient for a trier of fact to conclude, beyond a reasonable doubt, that Wilson was guilty as the actual shooter. View "People v. Wilson" on Justia Law

Basith v. Lithia Motors, Inc.
Plaintiff signed an online arbitration agreement before starting work at a car dealership. He had to sign if he wanted a job: the car dealership presented it as a take-it-or-leave-it mandatory condition. Plaintiff signed the arbitration contract, and the dealership hired him. The employment relationship turned out to be unsuccessful: Plaintiff sued the dealership for firing him. The dealership moved to compel arbitration. The trial court ruled the arbitration contract was unconscionable.
The Second Appellate District reversed. The court held that Plaintiff suffered no substantive unconscionability, which is indispensable to the unconscionability defense. The court held that, to some extent, the contract-at-issue seems to be a common form, at least for some car dealerships. Second, all four agreements containing the arbitration clauses extended for more than a page of print. Third, the font size and functional readability of the contracts here did not seem to trouble Plaintiff.
Further, the court explained that Plaintiff argues this language implies to laypeople that it bars filing a charge with the Department of Fair Employment and Housing or the Equal Employment Opportunity Commission. The court found that Plaintiff’s argument fails on two counts. As Plaintiff himself notes, there is clear language to the contrary: “I understand and agree that nothing in this agreement shall be construed so as to preclude me from filing any administrative charge with, or from participating in any investigation of a charge conducted by, any government agency such as the Department of Fair Employment and Housing and/or the Equal Employment Opportunity Commission.” More fundamentally, arguments about prolix legalese go to procedural and not substantive unconscionability. Takiguchi v. Venetian Condominiums Maintenance Corp.
Venetian Condominiums Maintenance Corporation was a condominium project with 368 condominium units in the University Town Center area of San Diego. It was a nonprofit mutual benefit corporation governed by the California Nonprofit Mutual Benefit Corporation Law. Ali Ghorbanzadeh owned 18 units at the Venetian. He was elected to Venetian’s board of directors in 2008. In 2009, Ghorbanzadeh appointed his son Sean Gorban to the board. They controlled the three-member board continuously from 2009 through at least 2021. Guy Takiguchi was elected as the third director in 2015. From 2009 to 2021, the board repeatedly failed to hold annual elections, either due to the absence of a quorum or for other reasons. Ghorbanzadeh’s seat was up for re-election at the 2020 annual meeting, and there were two other candidates for the seat, including Nishime. The Ballot Box, Inc. contracted as the Venetian's inspector of elections, declaring there was no quorum for the meeting because Ballot Box had only received 166 ballots, and the quorum was 188. Nishime participated in the January 20, 2021 meeting remotely by computer and took multiple screenshots of the participants. Nishime was able to identify eight members who were present (representing 37 units). Had those units been counted with written ballots, there would have been a quorum of 203 present at the meeting. The eight participating members who represented units for which no ballot had been submitted included Ghorbanzadeh (representing 18 units), his son Sean Gorban (representing one unit), his other son Brian Gorban (representing three units), and an ally of Ghorbanzadeh’s who was also running for the director’s seat (representing one unit). An allegation asserted Ghorbanzadeh and his allies did not submit their ballots “in a deliberate and tactical effort to not reach quorum so they could remain in power another year or two.” Venetian submitted no evidence refuting this accusation. The Court of Appeal concluded the trial court properly ordered Venetian to hold a meeting for the purpose of counting the 166 written ballots cast for its January 20, 2021 annual member meeting and election. Substantial evidence supported the trial court’s finding that there was a quorum present for that meeting. By adjourning the meeting based on the purported absence of a quorum, Venetian failed to conduct the scheduled meeting or cover the noticed agenda items, which included counting the ballots and determining the results. Fuentes v. Empire Nissan, Inc.
Plaintiff signed an arbitration agreement with Empire Nissan, Inc. Nissan fired Fuentes, she sued, and Nissan moved to compel arbitration. The trial court found the arbitration agreement unconscionable and denied the motion.
The Second Appellate District reversed and directed the trial court to compel arbitration, holding that this contract lacks substantive unconscionability. The court explained that Plaintiff must show both procedural and substantive unconscionability to establish the defense. These two elements need not be present to the same degree. Rather we evaluate them on a sliding scale. The more substantively oppressive the contract terms, the less evidence of procedural unconscionability is required to conclude that the contract is unenforceable. Conversely, the more deceptive or coercive the bargaining tactics employed, the less substantive unfairness is required. The court explained that tiny and unreadable print indeed is a problem, but is a problem of procedural unconscionability.
